Under the Migration Act 1958, individuals who provide immigration advice for a fee must be a registered migration agent (RMAs) through the Office of the Migration Agent Registration Authority.
Education agents working within Australia who are not a RMA can only provide advice on immigration matters to explain information that is publically available (e.g. information on the Department of Immigration and Border Protection website), as well as basic clerical assistance, including helping prepare a visa application, submitting a visa application on a student’s behalf, providing translation or interpretation services, and being nominated to receive correspondence on behalf of a student.
The legislation does not apply to education agents working outside Australia.
